Car wreck due to uninflated tires

A man removes a significant amount of air from two tires of an unsuspecting man's car late in the evening, between the hours of 10 p.m. and 2 a.m. while the car is parked in the owners driveway. The driver/owner of the car then leaves his house driving his car around 2 a.m. and gets into and accident and is injured/killed. Is the man who released the air from the tires of the unsuspecting man at fault for the accident/injury/death or is the driver for failing to check the air pressure in the tire before leaving for departure. What type of criminal actions could be taken against this man is so.
