Legal Question in Criminal Law in Washington
was charged with domestic violence in the 4th degree. Me and my wife had an argument regarding about the past and she kept on going and going until she lost it when i made a comment and threw her phone at me and some table mats. I didnt do anything or retaliated right away i just sat there until she continued to drill the same thing and then i lost it. I stood up and I put my hands on her neck I put pressure but not to the point she couldn't breath. I let go after a second and she called the cops. I got arrested for DV 4th degree. I wanted to know if I need a lawyer to represent me or can I represent myself?
1 Answer from Attorneys
You should absolutely seek the assistance of an attorney. Although a gross misdemeanor, there are consequences resulting from a domestic violence conviction that will affect your employment, participation in youth activities, gun rights and travel abroad. If you cannot afford an attorney, apply for a public defender. (What you cannot afford to do is represent yourself.)
You should then refrain from making statements concerning the case to any person OR ON WEBSITES. (Posts such as this can easily be traced to you).
