Legal Question in Criminal Law in Washington
I was cited for Shoplifting at Bartell Drugs in Seattle. I didn't get a basket so I placed batteries in my jacket, and selected items to purchase at the store. When I paid for items, I was stopped by security. I was told that I needed to follow them. I spaced out and forgot to include the batteries when I paid for my other items. So security cited me for Shoplifting and was banned to enter any Bartell's for 1 year. No cops were called and I had to sign two piece of documents. The total for both item is $16. What am I looking for civil penalies and will criminal charge be imposed? I told tehm it was a big misundersting and that I just forgot to pay for it and can pay it now. But they refused. They took a picture of me and item and had me sign two piece of documents.

Since no cops were called you may not be charged criminally. You should contact store security and ask for the report. If they don't have one then that's a good sign. Civil penalties are the amount plus $200. If you are charged, it's a gross misdemeanor subject to up to a year in jail and a $5000 fine. Your criminal history is the greatest consideration in determining how much, if any, of that jail will be imposed. Contact me directly for further assistance.
