DO you have to have the merchandise concealed to be charged with shoplifting?

No. You just need to demonstrate the intent to steal it. Concealing demonstrates this. Also, passing the cash registers without paying may demonstate this. In the end, the prosecutor must convince the jury of your ill intent.
