Third Degree Theft
hi,
I have been accused of third degree theft in Fry's electronics on saturday. I have a court date. This is my first offence ever.
Item theft was of around $200. I have no criminal record. I am on work visa. I am not US citizen.I have good reputation with client. Please let me know what may be the punishment/penalty? Do i need a lawyer? I am ready to pay the fine/penalty to fry's electronics. I am ready for community service also. Is there a chance of jail? will it
effect visa status? how can i avoid jail and immigration effects?

The maximum penalty for a theft 3 is 365 days in jail, on a first offense, however, you are unlikely to get much, if any, time. It is likely you will have the option of a diversion program, civil compromise, community service, a deferred sentence or other alternatives. Some of these may be better than others due to your immigration status. A criminal conviction is grounds for deportation, denial of admission or naturalization. You definitely need an attorney that understands the immigration consequences of the resolution of the case. You do not want to try and handle it on your own.
