Legal Question in Criminal Law in Washington

denied entry into Canada

My husband, who has traveled to CA numerous times was denied access the last time he attempted to cross due to a search of his past. He did have some ''activity'' on his file but that was over 30 years ago and paid his dues to society. Is there an attorney that can help with the pages and pages of paperwork that the CA gov't requires in order to be considered for re-entry?

There may be an alternative to a Certificate of Rehabilitation issued by the Canadian government. It depends on the particular crime.

Thirty years ago, deferred sentences were common. If the matter was dismissed, records may not have been updated.

It may be possible to vacate and/or seal your husband's conviction. Generally, either of these remedies would suffice.

In my experience, having represented many clients who face this issue, whether an offender is allowed entry into Canada on any given day depends on who's watching the gate.

If he does obtain a Canadian Certificate of Rehabilitation, it should settle the matter.
