Domestic Violence longivity of record.

I have a client who I am trying to find the answer to her question. She was changed with Domestic Violence. How long does the misdomeaner DV stay on a criminal history report in the state of Washington? It was a misdomeaner charge of DV.

Re: Domestic Violence longivity of record.

If convicted and the fact of conviction was transmitted to the Washington State Patrol and FBI, the record will be maintained indefinitely. Five years after she has successfully completed probation, she MAY* be eligible to have the conviction vacated (expunged), which means that although the record exists, it cannot be disseminated to the public.

If she was not convicted, she may still be able to have the arrest and charging information vacated from criminal history. You should review RCW 10.97.060.
