double jeapardy

i was sentetened to 11 months and served my time,and the state apealed the case.6 months later they said that i wasnt trialed right the first time,so now i have to be resentened to 1 year and a day. and i need serve 32 more days.well if i would have served a year and day the first time, i would have got a 1/3 off of my time for good time and would have only would have done 8 months. so i already served enough time anyway so i shouldnt even have to serve any more time, i believe thats double jeapardy,right! even the local judge didnt think that was right. i need some advise. please someone give me some advise. is this case double jeapardy?

You are correct that it doesn't seem right. However, to really know the nature of the error I'd have to review your case and the nature of the State's appeal. Who is your attorney in this matter?
