Legal Question in Criminal Law in Washington

Double Jeopardy?

I received NJP for writing 4k in bad checks to the exchange. Found guilty, received punishment, and got an Other than Honorable discharge. Now I have a Felony: Theft 1 arraignment court date in 2 days. Can I be tried for this twice? And if so, what can I do?

Re: Double Jeopardy?

Unfortunately, a little known aspect of the double jeopardy prohibition is that it only apply to being tried within the same jurisdiction. There are a number of other requirements for it to attach as well. It is possible you are protected against this new charge but unlikely. As to the new case, you should hire a lawyer right away. If this is in a Washington State Court I'd be happy to assist you. Contact me directly for more information.
