The sale of a a counterfeit drug is criminalized and punished the same as the drug itself. I don't believe mere possession of a lawful substance can be punished. Possession with intent to deliver may be charged if they can make a showing that you intended to engage in a fraudulent drug delivery. That would be a difficult case for the Prosecutor to win I should think. Contact me directly if you have an actual charge.
