Legal Question in Criminal Law in Washington
due process
Nine years ago I was ordered to get an anger management evaluation. I didn't. Today I learned of a warrant and got a court date to answer to this. Can I argue due process? I have lived in the same area and did not flee jurisdiction.

Re: due process
Actually, yes. There is a line of cases requiring the prosecution to use "due diligence" in bringing you to justice. Living in the same area (same address even better) for nine years does raise the possibility that they should have served that warrant and moved your case along many years ago.
