Legal Question in Criminal Law in Washington

dui, failure to appear in washington

december 22, 2005...i received a dui charge, hit an unoccupied vehicle. i went to court for the arraignment but was moving out of state before next court appointment. public defender said if i left and missed court date, they could issue bench warrant for washington state only. i would like to clear this up but my financial situation is not good. i am not trying to get out of it, i just need help. how can i take care of this with little money. if anyone can advise me i would greatly appreciate it. i have never been in trouble before, this is very scary. i also need to know if i can get a job if i have a bench warrant.

Re: dui, failure to appear in washington

Thank you for your question. A lot of people find themselves dealing with an old warrant. It can be particularly vexing handling a case from another state but you can do it. The main thing is to establish contact with you public defender. If you no longer know who that is contact the court and they can direct you. You may have a lot of phone calls and hold time in front of you. Once you are in contact with your Public Defender then can find out the plea bargain on your case. If the plea bargain is agreeable then you can set a warrant quash and plea date together, along with sentencing, and wrap the whole thing up at once. Depending on the plea bargain, you may need or want to have some things done ahead of time so the judge doesn't put you on probation.

If the plea bargain isn't agreeable then it becomes harder. Getting a matter to trial usually means a couple of court appearances not to mention the time here for the trial itself.

This is the most cost effective way to resolve the case. The easiest way is to hire a lawyer to take care of it for you. However, we tend to cost more than the public defender. Contact me directly if you have further questions.
