Legal Question in Criminal Law in Washington

DV sentencing

My brother has a hearing soon for his second offense of domestic violence. On the previous conviction, he was sentenced to 2 months in jail with a requirement of drug and alcohol rehabilitation after release. The most recent incident occured while he was sober. What kind of conviction/jail time is he looking at?

There are so many factors that go into a Judge's sentencing decision that it is impossible to predict without a consultation. Generally speaking, the sentence for the same offense will get more severe, the less severe sentence didn't get one's attention. He will likely get domestic violence offenders treatment which can be even more invasive that alcohol rehabilitation. If you'd like a consultation contact me directly.

Difficult to say based upon the facts you provided but no more than 1 year in county jail if the second offense is a misdemeanor. Whether or not he was on probation also matters.
