Legal Question in Criminal Law in Washington

errors in a police report

I had a gun pulled on me by an ex girlfriends new boyfriend. I called the police. When I called the detective a couple days later to get a status report, I was informed that no charges were being filed because his version of events ''was different'' than mine. I then got a copy of the report at the station and realized that neither my or a witness who saw the entire event statements were in the report. I believe that with my and a witnesses statements the detective would reconsider charging this individual. I wonder how I can get both of our statements into the report and how I can ask the department to reconsider charges on this person. I have had prior incidents with this individual and had a threatening note placed on my car 2 days prior.

In felony cases, detectives and patrol officers refer reports to prosecutors or at least consult with them. Only county prosecutors file felony charges. If you have concerns about the decision, contact your county prosecutor.

If you fear for your safety, consider petitioning for a protection order. Contact the court clerk's office in your city or county for instructions and forms.

It is horrifying that someone could pull a gun on you, that the event could be witnessed, and no action taken to protect you. If you would like my assistance getting the police or prosecutor to reconsider your situation please contact me directly. I can also assist you with getting a protection order to keep this person away from you, your residence and your work.
