Legal Question in Criminal Law in Washington

exonerated pending investigation

I was arrested for PCS in September of this year. I was not arraigned. Now, when I have called the court clerk, I am told that I do not have a case and the case is exonerated pending investigation. What is the statute of limitations for posession of controlled substance (oxycontin), or how long do they have to investigate the case?

Re: exonerated pending investigation

Sadly, they have three years. And drug cases usually are backlogged for testing at the lab facility. So, don't get your hopes up that the case has gone away. Make sure you address is current with the DOL since that's the address they will use when they finally file a case. Lastly, if you want a lawyer to fight the charge or make a good plea bargain, depending on the courthouse, contact me directly.
