Legal Question in Criminal Law in Washington

Expundgement in Washington

Can we expunge a second degree theft charge from March 2002? She pleaded guilty. This is her one and only charge ever on him record. She was 18 at the time and is now 24 years old. This occurred almost 6 years ago. We need to know if it's worth a try. Thank You.

Re: Post conviction relief in Washington

It is possible to have a conviction for theft in the 2nd degree vacated and sealed if the eligibility requirements of RCW 9.94A.640 and court rule GR15 are met.

Essentially, she must have no convictions for ANY crime since the date of conviction for theft and at least 5 years must have passed since a Certificate of Discharge was filed.

There may be other issues for her particular case. If you are unsure or need legal assistance, consult an attorney experienced in post-conviction matters.

Re: Expundgement in Washington

It is certainly worth doing. I'll do it for you if you'd like. I'll need to consult with her and get some documentation but it's possible she will not even need to appear in court.
