Legal Question in Criminal Law in Washington

Felony Discrimination in Employment

I was recently offered a job, and disclosed my felony conviction, and the offer was still given. Once my background check came back showing my conviction (8 years ago), they withdrew their offer. Is this considered discrimination?

Re: Felony Discrimination in Employment

It is not employment discrimination. Employment discrimination is reserved for race, creed, color, national origin, sex, marital status and sexual orientation. In addition, some examples of unacceptable discrimination in WA: if you are HIV/Hep C positive, have the presence of a mental or physical disability, use trained service animal, pregnant, retaliation for opposing an unfair practice, retaliation for whistle-blowing, or retaliation for filing a nursing home complaint. If you feel that you have been discriminated against, you should contact the WA State Human Rights Commission.

On a separate note, you should consider looking into having your felony vacated, if you qualify under the statute.
