Legal Question in Criminal Law in Washington

felony harassment

for about a week and a half these kids would drive by and flip us off and yell at us.. they stoped in a parking lot right next to us and told my friend to hit him because he is 17 and will go to jail..my friend is 19 . my friend then said ''no i will go get a gun and shot you...he never brought out the gun all though there was a 30-06 in the car..he was then aressted 5 min after...is there any way for instigating to play a role in what has happend?and if not what should he do? thanks.

Your friend, nor anyone else on his side, should not make any further statements to the police about what happened. Instigating will play a role but the fact that there actually was a gun present makes things much worse. Your friend should immediately hire an attorney.
