fighting marijuana charge 1st offense
so even though it says in the police report that he bought it and it was his and he was there when the marijuana was found, just because i was there i can be charged?

Not just because you were there but because it was in your possession. The legal concept of "constructive possession" means you may have possessed the marijuana and it would be your defense's obligation to prove otherwise.
