Legal Question in Criminal Law in Washington

Gun law in Washington State

I was in a McDonald to discuss a project with a contractor while 6 teenage throw food and paper on us. I walked to their table while my hand keeps close to my hip where I had a gun. I have license to carry concealed weapon. I told them no more then stop brother me. I walked back to my table and try to go on with meeting. Then I saw them ready to throw something at us again. I walked to their table 2nd time with my hand close to my hip again and tell them to stop. I pointed to my hand that is next my hip and say, “see this,” that was the spot their food landed, and told them to stop. I did not show the gun, and I never use any threaten words or told them I have gun or weapon or anything alike. I walked back to my table again. The police come and said my action is out of line and did not want to hear my explanation. They let me walk away but took my gun as evidence and say they will send a report to prosecutor to prosecute me for unlawful displace weapon to make other fear because I pointed to my hip to tell them, ''see this.'' I don’t have any criminal record. What are my defenses if I got charge?

Re: Gun law in Washington State

Well, I'd stop telling the story to anyone. I'd also take out the part "with my hand close to my hip" because it sounds like you are ready to draw the gun.

I'd take a picture of any food stains on the clothes. I'd get a declaration from the contractor and anyone else "on your side" who witnessed the event.

You should hire an attorney now and he/she might be able to keep the police/prosecutor from filing the case. Where are you located? Maybe I'll help you.

At your service,
