Held for questioning...

My brother was picked up for questioning in Peirce County, WA...that was at 4:30pm 4/10..and is still there. He has an alibi and witnesses to his whereabouts...how long can he be held for questioning with no evidence against him?

Re: Held for questioning...

A person may be temporarily detained for investigative purposes for a period of time no longer than necessary to determine their involvement, if any, in whatever crime the police are investigating.

For them to hold him for hours and hours at the station indicates to me one of a few things: He agreed to remain at the station while they checked things out; he had other reasons to hold him (warrants, etc.) or they thought they had enough to arrest him.

He may have already been making statements. Too bad he doesn't have access to this answer - I'd tell him to stop talking and ask for a lawyer.

He needs a local Washington criminal attorney ASAP.
