is it kidnapping?

Is it kidnapping if a parent took the kids out of the home they new and did not give them back and there was no court papers involved, If the one that the kids got taken from took them out of state to move back with family would that be considered kidnapping?

Unlikely, as both parents have a right to their children. It might be a lesser crime like custodial interference since the other parent has custody rights to their kids. I know this isn't what you want to hear but it is probably best to get this worked out in court. If you can come to an agreement you don't need to hire lawyers at all. Or, if you are willing to work together, I know a family lawyer who uses the "collaborative method" to save both parties money and heartache.

Remember, the children benefit from having both parents around. If one is abusive, the courts can help.
