my lawyer fails 2 gather information needed for my defense agrees to file motions but does'nt

Hire a new lawyer immediately! Your best chance to win is at the trial level. Appeals later, trying to fix what a bad lawyer did, are much more difficult that hiring a good lawyer to start. Keep notes of conversations you've had about what motions he/she agreed to file and when. That may be a basis for getting your money back later.
