Legal Question in Criminal Law in Washington

MISD-Prowl/Trespass1

Can a conviction of this type ever come off of someone's record? The person completed all court ordered requirements and received this as a reduced charge and conviction in 2000 in Washington.

Although the records can never be destroyed (expunged), it is possible to vacate the convictions. Once vacated, the offender can state for all purposes that s/he has not been convicted of the offense and state law enforcement agencies are prohibited from disseminating conviction information.

However, anyone can still view the court file or retrieve electronic data (by subscription service) indicating that at some point there was a conviction.

It is also possible to seal the file (after vacation of conviction). Once sealed, only the name, case number and whether the crime was DV related will be accessible.

You can find more info at www.courts.wa.gov in the criminal law forms section. If uncertain how to accomplish the task, consult an attorney who practices in this area of law.
