Misfiling charges?
My wife was arrested for assault, after talking to her, everything she said even if the evidence was totally misinterpreted, doesn't seem to meet the definition of 3rd degree assault. Is it possible to have the charges dismissed?

It is possible to have charges dismissed. If the prosecutor reviews the evidence and agrees that there is no basis for the charge it is their duty to dismiss the charge. Otherwise, you will have a trial and the jury will review the evidence and, if what you say is true, enter a decision of not guilty.
