Legal Question in Criminal Law in Washington
Nevada to Washington State: Felony or Misdemeanor
Hello,
I just had a quick question regarding the transfer of criminal records between the state of NV vs the state of WA. My boyfriend was arrested in NV in 2005 and pleaded down from a felony to a Gross Misdemeanor. He just received a notice in the mail that he has a felony on his record. We obtained a copy of his criminal record and it shows a Felony and not a Gross Misdemeanor.
My question is, dos the Gross Misdemeanor in NV translate to a Felony in WA or are they the same? Also wouldnt his criminal record show a conviction in NV or would it should be in WA since that is where we reside?
Any help is greatly appreciated as he may not be able to go to his school of choice due to the felony listed on his record.
Thank you,
w

Re: Nevada to Washington State: Felony or Misdemeanor
I am sorry to hear that this is causing a problem with his schooling. When you say you got a copy of his criminal record and it says felony my inclination is to think he really did get a felony and for some reason you were both under the misconception that it was reduced to a misdemeanor. However, you should get a copy of the court records. Contact the court directly for how to do this or you can contact a defense attorney in the area near the court for assistance. Get a certified copy of the real court record including plea agreement, judgment and sentence, and findings of fact if any. This should help you clear up the misunderstanding with the school.
