punishment before sentening

I took a plea bargain for assalt in the 4 th and 3rd. The deal was if i took a dv evaluation and did the recomended class i would be able to go back to court in with draw my plea and enter a new one to lesser chargesor if i failed the matter would go on to sentencing and would get up to 51 mounths.

My question is this legal it seems that i was being punished be fore being sentenced

You are arguably correct however if you raise the issue the Judge will just sentence you on the 4th degree imposing the DV treatment and give you the 51 months on the 3rd degree so ... if I were you I wouldn't complain.
