Legal Question in Criminal Law in Washington

restoring my rights

I was convicted of assault II in Oregon

in 1998. And I currently reside in

Washington State. I want to enlist in

the military, but I am not sure if this is

even possible. Is there anything I can

do to make this happen?

Re: restoring my rights

Whether the record of conviction disqualifies you from serving in the military is a question for the recruiter.

With respect to the right to possess firearms, which you have to regain to serve, you will need to petition a circuit court in Oregon for early reinstatement of gun rights (or wait until the 15th anniversary of your release from jail/protation)PROVIDED assault II is an offense that results in permanent loss of gun rights.

You will also need to have all of your core civil rights, e.g. voting, restored to be clear under federal law.

Finally, whether any relief obtained in Oregon will remove the separate firearm disability under Washington law will depend on the specific findings of the court in Oregon regarding rehabilitation.
