What are my rights if I don't sign away my rights to a speedy trial?

If you are charged with a crime, you have the right to a speedy trial within 60 days of your arraignment if you are in custody, and 90 days if you are out of custody. If you don't waive your right to a speedy trial, the prosecution would have to bring you to trial within those timelines or face dismissal of your case. That being said, the State or the Defense could request a continuance of your trial date, which would create an "excluded" period and extend your speedy trial.
