Legal Question in Criminal Law in Washington

Shoplifting - probation dismissed?

I was caught shoplifting (small

offense - only $100 in goods) and

was told I should await a notice for a

court hearing. 6 years ago I was also

accused of shoplifting (again, small

offense) and was put under probatin

for 2 years, after which it was

supposed to be dropped from my

record. My record remained clean for

those two years (and since)...but I

am just wondering if that record is

indeed removed from my recod and if

attories, judges, etc would see that

on my recod anyway?

Re: Shoplifting - probation dismissed?

Normally, there is always a "record" in the Court. I would check with the courts having jurisdiction and inquire of an attorney about expungement/vacation procedures.

Re: Shoplifting - probation dismissed?

Good question. There are a number of different "records." The most commonly referred record is the one available to the public through the Washington State Patrol. This is what can be viewed by landlords, employers, etc. There is a separate record in the state criminal record computer system that will show the case as charged and dismissed. Also, individual jurisdictions, like Seattle Municipal Court, keep their own records. So, to answer your question, the judge and attorneys will probably see your previous charge.
