What is the statute of limitations on a misdemeanor case that was dismissed with

About 6 years ago, I was accused of 4th degree assault in my workplace and the case was eventually dismissed without prejudice. What is the statute of limitations if the prosecutor ever wished to bring charges against me in future?

Re: What is the statute of limitations on a misdemeanor case that was dismissed

Per RCW 9A.04.080(1), http://search.leg.wa.gov/wslrcw/RCW%20%20%209A%20TITLE/RCW%20%20%209A.%2004%20%20CHAPTER/RCW%20%20%209A.%2004%20.080.htm: "No gross misdemeanor may be prosecuted more than two years after its commission."

But see limited exceptions in section (2) and (3).

Under RCW 9A.36.041, http://search.leg.wa.gov/wslrcw/RCW%20%20%209A%20TITLE/RCW%20%20%209A.%2036%20%20CHAPTER/RCW%20%20%209A.%2036%20.041.htm, Assault 4 is a gross misdemeanor.

Under RCW 9A.04.080(3), it appears the statute began to run the day of the order of dismissal. Since the statute for a gross misdemeanor is 2 years, it would appear the statute has run unless you were "not usually and publicly resident within this state" for the specified time. Do the math based on the date of the order of dismissal.

If the prosecutor thinks otherwise and this answer does not persuade him, get an attorney.
