Statutory rape

My boyfriend is 19, and i'm 16. He's 42 months older than me, give or take a month(depending on how they count it). We haven't had sex, nor do we intend to for a good while, but regardless of that, my moms threatened to have him arrested on statutory rape charges. I tried to read Washington law, but the legal speak sent me for a spin, and I would like a definitive answer, if possible. At 42 months older than me, can he be held on statutory rape charges? Any help would be very much appreciated, thanks!

Yes, he could be charged with rape at that age difference. And don't think that just because you haven't had "sex" yet he is safe. "Sex" is very widely defined as any penetration of any of your orifices by anything. So, he could stick a finger in your mouth and be technically guilty of rape.
