can i sue the person that stole my car after its been recovered?

It depends upon a number of factors. How long ago did the theft occur? How long ago was the vehicle recovered? Was the thief found, arrested and prosecuted? Payment for your damages to your vehicle should have been part of a criminal case resolution which required the thief to pay you restitution for your damages. You have to speak to the prosecutor about that before the thief's case is concluded by sentencing. If there was no criminal prosecution, then you have the burden of proving in a civil trial for damages against the thief that he or she stole your vehicle and caused the damages. (The vehicle could have been stolen or taken, then abandoned and then later vandalized, or stripped or otherwise damaged by other unknown third persons.)
