The short answer to your question is that the maximum possible sentence is 5 years in prison and/or a 10,000 dollar fine. The standard sentence range varies based on criminal history. Exceptional sentences outside of the standard range (either upwards or downwards) can occur for too many reasons to summarize. Also, if there are weaknesses in the evidence or equitable reasons for the prosecutor to offer a plea bargain of a misdemeanor, which has indeterminate sentencing, there is almost no limit to the creative sentences available to the parties and Judge. Theft one is a class B felony. The maximum sentence is 10 years, the maximum fine is $20,000.00. Any sentence will depend on your criminal history as that is statutorily defined. The more applicable history the higher the number of points. The higher the number of points the higher the sentencing range. For example: if you have 0 points, the standard range is 0- 90 days; if you have 9 or more points, the standard range is 43-57 months. Hope this helps.
