Anyone can receive a maximum sentence on any charge if the judge, in his/her discretion, finds sufficient aggrevating factors. Past criminal history, in this case none, is one of those factors but there are others. The vulnerability of the victim (stealing from an old lady), the nature of the theft (stealing her social security check), and so on. So the actual "how long" is 5 years in jail and $10,000 fine, the maximum for a class C felony. However, you will likely get a standard range sentence which I believe is 0-60 days.
