Provided your offense is not assault 3rd degree or a sex offense, you should be eligible to vacate the conviction on the fifth anniversary of your certificate of discharge. If a certificate of discharge has not yet been filed, you are entitled to one with an effective date indicating when the court had notice that you had completed all of obligations under the judgment and sentence. For EXAMPLE, if your DOC supervision was terminated on 1-31-04, but you made your last LFO payment on 7-31-04, you are entitled to a Certificate of Discharge dated 07-31-04. Continuing this example, you would be eligible to vacate the conviction on 07-31-09.
