Legal Question in Criminal Law in Washington

truck seizure

It has been since 10-12-06 that my truck was seized, i have followed all of the police procedures regarding requesting it back, and have not heard from them as to when a hearing date will be, they have broken so many of the rcw rules as to time and notices regarding a civil seizure, i cant afford an attorney so now what? any comments? or suggestions?

Re: truck seizure

I just dealt with a forfeiture case and successfully got my client's laptop returned to her. Which precinct are you dealing with? Unfortunately, following the "police procedures" may not be enough to get it back. You need to follow the "legal procedure." I am hoping that very early on you submitted a written request identifying your property. That said, you need to work your way up the supervisor chain, preferrably in writing, until you get to the chief. Keep copies of everything you send and send it certified mail. If you decide that your truck is worth the cost of a lawyer contact me directly.

At your service,
