The 23 year old can be charged with a crime and be labeled as a sex offender for the rest of his or her life. Believe me, it's not worth it. Sex offenders are kept out of a huge variety of jobs, their pictures are posted, neighbors and employers hate them, and when they're in jail or prison they frequently get beaten up because of being a sex offender.

I don't think the 16 year old will get into legal trouble, but is it really worth ruining someone else's life if he or she gets caught?
