breathalizer results in a court appearance
if i was stopped for dui, but my breathalizer results were less than the legal limit, could i plead not guilty in court?

I advise anyone charged with a crime to ALWAYS plead not guilty. This is not committing perjury; its the way our system works. The state has the burden of PROVING your guilt beyond a reasonable doubt. If the state doesn't have a good case, oftentimes, you or your attorney can get a better result. In your case, since you were below the legal limit, it is possible that you might get a better resolution if you hire an attorney to look into the specific facts of your case and negotiate a better deal with the prosecutor or take it to trial and make the state prove its case. After all, that is the prosecutor's job. Don't make his job too easy by pleading guilty.
