Should I have to call?
Late last night I curved off the road
and left my car upside down in the
ditch. I was probably a considerable
amount over the legal bac. My
parents in the morning had the car
towed but the cops did stop and took
a look through my car and found a
baggie of about less than .5 gram of
pot. Now the officers haven't
contacted me but they have given
me a number to call them for a
statement. what should i do

You've created quite the dilemma here. Fortunately, it appears quite difficult to construct a DUI case given these facts,as there is only circumstantial evidence tying your driving to any intoxicant. However, there are other potential criminal charges here, the obvious one being UPCS (unlawful possession of a controlled substance). You may also find yourself charged with something pertaining to having left the scene of the accident. The "statement" the officers seek from you could (and most likely will) form the basis for these charges. It is thus unwise to go into this without an attorney at your side.

There are a number of serious potential charges that can be brought against you. Fortunately for you, it will be a difficult case for the prosecutor absent your statement. You should hire a lawyer to call the police officer for you. Contact me directly if you'd like further assistance.
