Is there ever a case where you do not have to do any jail time?

Many cases charged as DUIs are resolved via negotiated settlements to diversionary programs. However, assuming there is no such negotiation, and speaking strictly of DUI and Washington State, if the charge is a FIRST TIME DUI, the court has the option to allow a minimum of 15-30 days of electronic home monitoring (depending on BAC level) as opposed to an imposition of jail time. This is the only instance where jail time is not an absolute. For second and subsequent offenses, there is no such alternative.
