I plead guilty to dui,and got my sentance, but cant a clear anwser about the interlock? I have two past dui in 87-89 which isover 16 years old, so do i have to have the interlock on car?

Dear Sir,

Thank you for your question. The answer to your question is likely yes, you must have the interlock. District or Municipal court is a court of "indeterminate" setencing which means there are not many guidelines or constraints on how a judge sentences you. On a DUI the judge can give you up to a maximum in jail of one year and $5000 fine. He can reduce that sentence based on any condition he thinks appropriate. With two prior dui's, no judge is likely to think it inappropriate if your judge gave your the maximum sentence. Also, any judge reviewing your case would probably find it lenient if you received less than the maximum and all you had to do was put an interlock on your car. I am sorry as I do not think this was the answer you were hoping to receive.
