Legal Question in DUI Law in Washington

DUI #3 Revoked Deferred Prosecution

I attempted the deferred program on my second dui and did a lot of treatment. I was not ready to quit drinking for whatever reason and I got revoked from deferred. I took the charge and did my time. I know you are only allowed one in a lifetime but since I didn't go through with the program could I petition the court to let me try it again? I am 100% sure I want to stop drinking and do the treatment.

Re: DUI #3 Revoked Deferred Prosecution

You can always go through the intensive outpatient treatment program and voluntarily follow the steps required for a deferred prosecution. But you cannot do it AS a deferred prosecution in an attempt to obtain a dismissal of a DUI. It can only be entered once in a lifetime for this purpose, whether one is successful in completing it or not.
