Legal Question in DUI Law in Washington

Outstanding Warrent

I have to be fingerprinted for my new job, I found out (by looking online) that I have an outstanding warrent for missing my court date for a deferred DUI. When I go in to have my fingerprints scanned will I be arrested?

Re: Outstanding Warrent

As long as you have a warrant you are subject to arrest by law enforcement. The only thing preventing that arrest is their lack of knowledge about your warrant status. Many law enforcement personnel run a warrants check on any individual they encounter. So, if the fingerprinting is being done by a law enforcement agency the chances are you will be arrested. Ideally, you'd get back in compliance with the terms of your deferred prosecution and return to court to quash your warrant.

Are you going to a law enforcement agency to have your fingerprints scanned? If so, then they have a duty to act on the warrant. But they also have the option to tell you to go deal with it. Unless they run a warrant check on you, they might not even know about it.

First things first, got to the court and set a motion to quash the warrant.
