You are describing a situation (charge and underlying cause) that may be suitable for a deferred prosecution, a 5-year commitment to treatment and abstinece alternative to a trial/plea.
If successfully completed, the DUI is dismissed. Failure to successfully comply with ALL requirements of the program could lead to removal from the program and conviction. Deferred prosecution is an excellent alternative for many, but not all defendants.
You should not go through a DUI prosecution without legal representation. There are a multitude of legal issues in court and in DOL license revocation proceedings that require experience and expertise.
Enter a plea of NOT GUILTY. If you cannot afford to hire an attorney, apply for a public defender. An attorney will be able to review the strengths and weaknesses of the state's case as well as your defenses.
Finally, even if your case is dismissed on legal grounds, nothing stops you from seeking the treatment you state that you need. lt appears that you are presently on the right path. An attorney can help you get through the process.
