Legal Question in DUI Law in Washington
No tests or ticket issued
This weekend a friend of mine wrecked is car. I went to to see if I could pull him out. We were leaving the scene when a cop pulled up and asked us if we had anything to do with the car in the ditch. He said he smelled alcohol and had me get out of the car. He placed me in cuffs and put me in the back of his car. He then went to talk to my friend and placed him in the car with me. Then the cop took us to a local restaurant and dropped us off. We were not read our rights, no field sobriety test was performed nor a BAC test. Can they still charge us?
