Out of town DUI marijuana in WA

I'm from Utah. I got pulled over in Washington state, and the cop smelled weed. My friend and I had both smoked earlier in the day, so the car smelled like burned smoke. The cop told me I might not have to go back to Washington for a hearing. Is this true? Also, this is my first DUI charge, and could there be a way to avoid jailtime?

If the prosecutor decides there isn't enough evidence to proceed against you (like the cop didn't think you were under the influence) then you will not need to come back for a hearing (as there will not be a case). There is mandatory jail time on a first DUI so unless your attorney can get the charge reduced you will have to do some form of incarceration.

If you do get charged you will want the attorney to have the matter resolved so you only need to come here one time. You'll probably need to hire an attorney if you want that done. Contact me directly if you need more help.
