wrongly arrested and jailed

My husband was arrested and temporarily jailed because of a refusal to breathalize, suspended liscence (because of this), DUI charge. We were pulled over for speeding and supposedly this had happened previously. His wallet was stolen by someone we know and when my husband watched the video of the previous arrest (that was not him) recognized him. Although he is in jail until this is verified by a judge. apperently this man used my husbands identity. How does this happen? What can be done about it? What should we do now? When he is found not guilty what should we do?

When your husband gets a new driver's license I believe the DOL gave designate it so that people who run the license know that someone is using the ID falsely. Then the person checking the ID can get more corroborating information. Contact the DOL. I am also sure that the individual responsible will be charged with an additional offense.
