Legal Question in Elder Law in Washington
Out of State Restraining order overturn?
My sister who lives in WA state
got a 1 year RO against me although I haven't seen her in 45
years nor ever been to WA state.
....After severe mental cruelty against me after my 89 yr old dad died and cut me out of will, I went
beserk, being in dire poverty. I wrote tons of letters to her to convince her to share dad's desparately needed estate money
with me, since I'm on SSI and she's
rich. She also refused to allow me
to see contents of dad's house. I'm
68 and she is 70.
Since I was in severe mental distress for two years over this, can I get this RO dissoved on a mental cruelty basis, or some other
basis?
I have nightmares every night in fear of arrest. If arrested, I would lose everything in my apartment, &
all personal papers.
I have no resources, pension, property or family to turn to, living
alone all my life.
How can I get this unfair Restraining order overturned?

You can't. The RO is only for a year. There are no evidentiary standards in this sort of court; all she has to allege is that she was frightened. That's enough. You know that you are not responsible for her alleged fright.
It's only for a year. So long as you don't travel to washington and accidentally wind up within 300' of her, you do not need to fear being arrested.
