can he take 50% custody

we were together for 11yrs, seperated for 8 months, he finally got child support paper work, he is now demanding 50% custody so he doesnt have to pay, he refuses to pay, he has a checkered past with alchol, leaving the kids alone and being verbally abusive to our son does he have a chance to make a fight?

More relevant to a court's decision on what to do about a parenting plan than his checkered past would be what has been his level of involvement with child care, parenting, and what is his current situation with alcohol. A parenting plan that provides that the children are with him 50% of the time does not guarantee that he will realize a significant reduction in the amount of his child support obligation, other factors have to be looked at also.
